Recent judgement passed by the Supreme court stated that a person who has acquired right over a property as it was in his possession for 12 years can file a suit to re-claim it in case of forced dispossession by the original owner or any other party under the Doctrine of Adverse Possession. In other words, a person who is not the original owner of the said property but is in possession of the said property and is maintaining the property for 12 years can re-claim the property even if the original owner tries to dispossess him.
Now this judgement has had a nightmarish effect on the NRIs as they have properties, lands back home to which they are the true owners, and such properties are under the possession of other party for maintenance reasons.
Now this could mean that if the owner is unable to fly back and possess rightful claim to his land due to any number of reasons, could mean them losing their lands their properties.
